Orlando Partner, Raymond E. Watts, Jr., and Associate, Patrick L. Mixson, received a defense verdict in the Marteny, Diane (E/O) v. Irma Alves, M.D. case. The Plaintiff contended that the Defendant hospitalist improperly ordered Lovenox after a renal biopsy, contingent upon approval from interventional radiology, which performed the biopsy. Lovenox was given contrary to the terms of the hospitalist’s order. Discovery revealed that the hospital pharmacist failed to accurately transcribe the medication order and that the nurses did not identify the pharmacy error. The Defendants obtained a directed verdict on Fabre negligence as to the non-party hospital, but the jury returned a complete defense verdict.
