Jim Girman from Pion, Nerone, Girman, Winslow & Smith received a defense verdict in a trip and fall case at a Cinemark theater near Pittsburgh, Pennsylvania. The Plaintiff-wife alleges that she tripped over a floor mat in the vestibule of the theater that had buckled. Plaintiffs’ architectural expert testified that the floor mat should have been secured to the tile floor and was the sole cause of the Plaintiff’s accident.
Plaintiff suffered a fractured left shoulder that required a reverse arthroplasty procedure. Plaintiff, who is 68 years old, had limitations of her left arm and left shoulder following surgery. Her medical specials included a Medicare lien of $19,000. Her husband made a loss of consortium claim. The jury was out 90 minutes before issuing a defense verdict.
