Roger Hurt and Bryan E. Stanton of Pierce Couch Hendrickson Baysinger & Green L.L.P. obtained summary for an interventional radiologist in a wrongful death lawsuit filed in District Court of Oklahoma, Oklahoma County. In the suit, the Plaintiffs claimed the physician Defendant negligently placed a gastrostomy tube into the decedent based upon the fact the tube came out a few days after the procedure a day before the Plaintiff died. Summary judgment was sought on the basis that Plaintiff’s expert witness was not qualified because his testimony failed to meet Daubert criteria. The court held in favor of the Defendant physician with a specific finding that Plaintiff’s expert is not qualified and his testimony fails to meet Daubert requirements to give standard of care or causation opinions in the case.
