Kunsch obtains defense verdict for American Multi Cinema, Inc.
Sweeney & Sheehan partner Michael Kunsch recently obtained a defense verdict in a movie theater premises liability matter following a four-day trial before Judge Marlene Lachman and a jury in the Court of Common Pleas of Philadelphia County. Plaintiff claimed that he was injured when he fell in a concession area of the AMC Neshaminy 24 Theatre. He alleged that AMC was negligent in that it failed to warn him that the floor in the area was wet after an AMC employee had cleaned up a prior spill. AMC established that its employee had placed a yellow warning cone in the area after remediating the spill, and that plaintiff disregarded the cone in directly approaching the area and causing his own fall. After deliberating less than one hour, the jury returned a unanimous verdict in favor of AMC, finding that it was not negligent.
